Please read these Terms & Conditions and Privacy Policy carefully before using our website, contacting our team, or availing any services provided by TREE – The Real Estate Experts (“TREE”, “Company”, “we”, “us” or “our”).

By accessing our website, submitting your details, contacting our representatives, visiting or inspecting any property introduced by us, or using any of our real estate services, you acknowledge that you have read, understood and agreed to these Terms & Conditions.

1. PRIVACY & CONFIDENTIALITY

TREE respects the privacy of its customers, property owners, buyers, sellers, tenants and other visitors.

Any personal information shared with us, including your name, mobile number, email address, property requirements, budget, preferences and other information provided for the purpose of real estate services, will be handled with reasonable care and used primarily for providing and improving our services, communicating with you, and assisting with your property requirements.

We will not intentionally disclose your personal information to unrelated third parties except where required for providing the requested service, facilitating a transaction, complying with applicable law, or with your consent.

2. PROPERTY INFORMATION & INTRODUCTION

If TREE or any of its representatives, employees, associates or authorized agents:

  • Shares property details with you;

  • Introduces you to a property owner, developer or seller;

  • Arranges a property visit or site inspection;

  • Provides the property address or location;

  • Shares photographs, videos, brochures, documents or other property-related information; or

  • Provides any other information that enables you to identify or contact the property owner/seller,

such property shall be considered a property introduced or facilitated by TREE.

3. NO DIRECT DEALING / BYPASSING TREE

Once a property has been introduced, shared, discussed, visited or facilitated by TREE, the customer shall not directly negotiate, purchase, sell, lease, rent, book or otherwise enter into any transaction concerning that property with the owner, seller, developer, landlord or any related party without informing TREE and without involving TREE in the transaction, where such involvement is applicable under the agreed brokerage/service arrangement.

The customer shall not intentionally bypass, circumvent or exclude TREE for the purpose of avoiding or reducing the brokerage, professional fees, service charges or other agreed consideration payable to TREE.

4. VALIDITY PERIOD

The above obligation shall remain applicable for a period of 12 months from the date on which the property was first introduced, shared, shown or discussed with the customer by TREE, unless otherwise agreed in writing.

Any transaction relating to such property during this period may be considered a transaction resulting from TREE’s introduction or services, subject to applicable law and the agreed terms between the parties.

5. BUYER’S RESPONSIBILITY

If a buyer purchases, books, leases or otherwise acquires a property after the property has been introduced or facilitated by TREE, the buyer agrees to pay the applicable brokerage/professional/service fees as mutually agreed with TREE.

Failure or refusal to pay agreed fees after completion of a transaction may result in TREE taking appropriate steps to recover the outstanding amount, including legal remedies available under applicable law.

6. SELLER / PROPERTY OWNER’S RESPONSIBILITY

If a seller or property owner engages TREE for the sale, lease, rental or marketing of a property and a transaction is completed through TREE’s introduction, efforts, negotiation, marketing or facilitation, the seller/owner agrees to pay the applicable brokerage/professional/service fees as mutually agreed.

Failure or refusal to pay agreed fees may result in TREE taking appropriate steps for recovery of the outstanding amount, including legal remedies available under applicable law.

7. PROPERTY INFORMATION

Property information such as price, area, availability, specifications, amenities, photographs, location, possession date and other details may be provided by property owners, developers or other sources.

While TREE makes reasonable efforts to provide accurate information, customers are advised to independently verify all property documents, approvals, title, ownership, measurements, specifications, pricing, availability and other relevant details before entering into any transaction.

TREE shall not be responsible for any inaccurate or subsequently changed information supplied by a property owner, developer or third party, subject to applicable law.

8. PROFESSIONAL SERVICES

TREE may provide services relating to residential properties, commercial properties, land, pre-leased properties, rental properties and other real estate opportunities.

The scope of services and applicable brokerage/professional fees may vary depending upon the transaction and shall be communicated or mutually agreed upon between TREE and the concerned party.

9. ANTI-CIRCUMVENTION

Customers shall not use information, contacts, property details, documents, introductions or other services provided by TREE for the purpose of completing a transaction independently with the property owner, developer, seller, landlord or any associated party while intentionally excluding TREE from the transaction.

TREE reserves the right to seek recovery of its agreed fees and pursue appropriate legal remedies where permitted by applicable law.

10. WEBSITE USE

The content of this website, including property listings, photographs, descriptions, logos, text, graphics and other materials, is intended for general information and real estate service purposes.

Users shall not reproduce, copy, distribute, modify or commercially exploit website content without prior written permission from TREE, except where permitted by applicable law.

11. CHANGES TO TERMS

TREE reserves the right to modify, update or amend these Terms & Conditions and Privacy Policy from time to time.

Any updated version published on the website shall become effective from the date of publication, unless otherwise stated.

12. ACCEPTANCE

By contacting TREE, submitting an enquiry, requesting property information, visiting a property introduced by TREE, or availing our services, you acknowledge that you have read and understood these Terms & Conditions and agree to comply with them.
